SECRET COUNCIL MEETING FEB 7, 2000

 

The City Council met in session on Monday evening, February 07, 2000 at 7:00 p.m. with Mayor Harold L. Ludwig presiding and the following Council members present: Lowe, Wiewel, Martin Ayers and Sherwood. Absent from the meeting Burbridge.

Mayor Ludwig stated before opening any of the bids received for the labor on concrete work he would like to discuss the construction and erection of both the Maintenance and Fire Station building. Mayor Ludwig stated it has been brought to his attention that several people feel, the advance payment received from Mark Twain Casino, was only to be used for the building of the Fire Station. Ayers stated that was the impression he had gotten from the meeting. Mayor Ludwig stated this project first started with seeking bids on building a maintenance building. After meeting with Mark Twain Casino and they approved the advance the City Attorney presented this along with other information regarding the meetings and he stated to the Council, the advance payment would further help the City a long with building a Fire Station. Ayers stated the maintenance building was never mentioned in the same breath when discussion was held on getting the advance, only a Fire Station. Mayor Ludwig stated if part of the advance payment was not going to be used to help build the maintenance building then there will not be enough money to complete the project from just using money received from the selling of property. Martin asked if Mayor Ludwig had gotten in touch with Seckington regarding the advance payment. Mayor Ludwig stated he had spoken to Seckington, and they have asked that the advance not be used until after the 23rd of February. Ayers stated it was originally agreed to release the advance payment at the end of January. Ayers stated an agreement is an agreement and the money should be released. Mayor Ludwig stated if the site for the Casino is not approved, and the City spends the money, how would it be repaid. Ayers stated he had personally spoken to Seckington, and he had asked the same question, and he was told not to worry, the money would not need to be repaid. Mayor Ludwig and Martin both stated, the money was given in advance, with conditions it was to be put in an interest bearing account, and to be released once the Casino site was approved. Mayor Ludwig stated at present the City had $39,516 from the sell of property, and $30,000 of this has not been released yet to the City. Money has already been paid out from this account towards the purchase of the property from Childers through the City Attorney, $11,000 down payment on both buildings and a bill was paid to Cross Roads in the amount of $251.23. Mayor Ludwig stated there are already several other bills downstairs waiting for payment. Martin asked if an estimated cost was put together for both buildings. Ed Ensor stated he had an estimated figure of $157,000 that would include the buildings, gravel and cement, but no electrical or heating. Greg Heindselman stated that he had an estimated figure of $10,000 on electrical for the Fire Station and $4,000 on electrical for the maintenance building. Discussion was held on not adding the training room in the fire station, dividing room and restroom in the maintenance building. Wiewel stated a list of priorities should be made and start from there as far as what is needed first. Ensor stated he had been contacted by the erector company and they were not notified of this project being prevailing wages, and there will be an increase of $900 on the original erection cost of $10,000. Ensor stated if the City did not go ahead and using this agreement the next bid is $17,000 per building to be erected. Ensor stated he would contact this company and asked for a new contract without any change orders since the first contract was not signed. Discussion was held on postponing poring the aprons on either one building or both.

Mayor Ludwig stated the City should know for sure on the cost of each building after the 29th of this month, since all bids should be in for the electrical, heating, concrete and labor. Martin stated he did not think the Council should try to decide which building should be completed first. Mayor Ludwig stated he would like to know if the advance payment is to be used strictly for the Fire Station or should all the money be lumped together and used towards both buildings. Or did the Council want separate accounts for each building. Ayers stated he thinks that is the way it should be. Sherwood stated if the Council did that then they would be having a meeting every other week moving money from one account to the other. Martin motioned to lump all money received from the sell of property, and the advance payment from Mark Twain Gaming together and build both buildings at the same with both buildings beings workable. Lowe second the motion. Motion carried all five yes.

Opening bids for labor on concrete: The following bids were received as sealed bids.

Big River Contractors: Labor only cost for both sites $56,640.00

Shirey Construction: Per spec. $22,850.00

Heimer Construction: Material and labor $30,187.00

Baker Brothers Construction: Labor $37,550.00

B & D Concrete: Labor and backhoe $42,846.00

Ensor Construction: Per spec's $16,300.00

Ayers asked if any of the bids listed the cost of the apron separate. Ensor stated no. Ayers asked how much concrete would be needed. Ensor stated 390 total yards and he had figured a high estimated cost of $25,000. Ayers motioned to accept Ensor Construction bid for labor.

Wiewe/Sherwood both second the motion. Motion carried with all five yes. Amending the City budget: Mayor Ludwig stated the Finance Committee had met and discussed setting up the money received from Mark Twain Gaming as it own entity in the budget. This will allow an easy control over the income and expenses. Ayers asked why does this have to be done. Martin stated this would help answer any questions regarding money received from the Casino and where the money was spent. Martin stated in the future money received from the Casino would be used toward major projects like buildings and roads. Martin stated if Ayers had a problem with this, it did not have to be passed tonight, and it could be brought up at the regular Council meeting on the 14th. Ayers stated he would not understand it any better on the 14th then he does now. City Clerk Spindler told Ayers this would be set up in the budget just like the water and street. The accounts would show how much money has been received to date from Mark Twain Casino, and since the City had designated for being used to build the Maintenance building and Fire Station expense account reflect this Sherwood motion to amend the budget to set up accounts for income and expense from Mark Twain Casino. Lowe second the motion. Motion carried with the following roll call vote. \Wiewel YES, Martin YES, Sherwood YES, Lowe YES, and Ayers YES.

Having no further business before the Council. Martin motioned to adjourn. Sherwood second the motion. Motion carried all five yes.
